It saddens us to have to publish such Terms and Conditions but Events are getting harder to hold due to the behaviour of a small minority at other events.  As a result insurers and venue owners are becoming far more hesitant to allow the type of events we like to hold and participate in.  SO don't be a Dick!

WESTERN AUSTRALIAN HOT ROD ASSOCIATION INC. EVENT ENTRY and PARTICIPATION TERMS AND CONDITIONS

Applies to

These Terms apply to vehicle meets, displays, cruises, gatherings and associated activities (Event), including arrival, attendance, vehicle movement within the venue and departure.

They apply to every driver, passenger, spectator, vendor, volunteer and other person attending or participating in the Event (Attendee).

Event Management means the Event Organiser, the venue owner or operator and their authorised officers, employees, contractors, officials, marshals and volunteers.

Purpose

The purpose of these Terms is to:

• support lawful, safe and respectful vehicle events;
• protect attendees, pedestrians, staff, neighbouring businesses, road users and property;
• reduce the risk of collisions, injury, excessive noise, property damage and disruption; and
• make clear that unlawful, dangerous or anti-social conduct is not authorised, not condoned and may be reported to authorities.

Acceptance and general obligations

Entering the venue or participating in the Event constitutes acceptance of these Terms.

If you do not agree to these Terms and Conditions you must withdraw from the event and leave the venue immediately.

Each Attendee must:

• comply with all applicable laws, including Western Australian Road laws;
• follow signs, markings and reasonable directions given by Event Management or emergency services;
• act safely and with proper regard for pedestrians, other vehicles, neighbouring businesses and the public;
• respect the venue, other people and their property; and
• immediately stop any conduct that Event Management reasonably considers unsafe, unlawful, disruptive or inappropriate.

Lawful and respectful conduct

The following conduct is prohibited at the Event:

• threatening, intimidating, abusive, aggressive, violent or harassing behaviour;
• fighting, throwing objects or deliberately obstructing a person or vehicle;
• interfering with another person's vehicle or property without permission;
• damaging the venue, landscaping, equipment, another vehicle or other property;
• refusing a reasonable direction from Event Management; and
• any other conduct that creates an unreasonable safety risk or materially disrupts the Event, neighbouring businesses or the public.
• The unlawful use or consummation of drugs and/or alcohol.

Arrival, parking and departure

Drivers must:

• approach, enter, move within and leave the venue slowly, lawfully and under proper control;
• obey posted speed limits and use designated entry, exit and traffic routes;
• always give way to pedestrians and exercise particular care near entrances, paths, displays and groups taking photographs;
• remain within marked or designated vehicle areas and not overtake within the venue unless it is safe and permitted;
• keep entrances, exits, driveways, pedestrian routes and emergency access clear;
• park only in the designated or allocated area and move the vehicle only to enter, leave or reposition it as directed;
• switch off the engine while parked when reasonably practicable; and
• merge into surrounding traffic safely and without obstructing other road users.
• Vehicles must not be driven around the venue for entertainment or positioned so that they obstruct the safe movement of pedestrians or other vehicles.

Prohibited driving and noise

WAHRA, the Event Organiser and the Venue Operator do not authorise, encourage or permit unlawful or dangerous driving. The following conduct is prohibited at the venue and in connection with arrival at or departure from the Event:

• burnouts, attempted burnouts, tyre spin, wheelspin or any deliberate loss of traction;
• drifting, donuts, power slides, handbrake turns or deliberate loss of vehicle control;
• racing, street racing, rolling races, acceleration contests or informal speed competitions;
• aggressive launches or acceleration, dangerous or reckless driving, or using a vehicle to intimidate another person;
• repeated or unnecessary engine revving, throttle blipping, high-RPM launches or noise demonstrations;
• deliberately creating excessive tyre, engine or exhaust noise for spectators; and
• music or other noise at a level that unreasonably affects the Event, venue, neighbouring premises or the public.

Nothing connected with the Event - including an invitation, route, gathering, display or direction - is permission to engage in any of this conduct.

Public roads, cruises and surrounding areas

Public roads remain subject to all applicable road laws and the directions of authorised authorities. Attendees must not treat surrounding streets, nearby business areas or public roads as an extension of the venue.

• Do not gather, stop or park in a way that obstructs traffic, driveways, access to neighbouring businesses or emergency services.
• Do not use the venue entrance, exit, cruise route or surrounding roads as a location to begin or perform prohibited driving.
• During a cruise or other on-road component, obey speed limits, maintain safe separation and do not race, travel in an unsafe formation or obstruct other road users.
• Conduct away from the venue that can reasonably be assumed as connected with the Event may result in exclusion from the Event or future events and may be reported to police or another relevant authority.
• Event officials may guide vehicles within the venue. No Event official or Attendee may stop or direct public-road traffic unless that person has the legal authority and any required accreditation to do so.

Driver, passenger and vehicle responsibilities

Each driver and vehicle owner is responsible for:

• the lawful and safe operation of the vehicle;
• ensuring the driver is appropriately licensed and fit to drive;
• ensuring the vehicle is roadworthy and appropriately registered where required;
• their own conduct and the conduct of passengers accompanying them;
• any damage, spill or clean-up caused by their vehicle, to the extent permitted by law; and
• ensuring the vehicle does not leak oil, fuel, coolant or another substance onto the venue and promptly notifying Event Management of any leak or spill.
• Any participant at the event or vehicle who causes damage may be held responsible for the damage and reasonable clean-up or repair costs, to the extent permitted by law.

Alcohol, drugs and impairment

• No person may drive while affected by alcohol, drugs, medication or another substance to the extent that it impairs, or may impair, safe and lawful driving.
• If Event Management reasonably believes a person may be unfit to drive, it may direct that person not to drive within the venue, encourage alternative transport and contact police or emergency services where appropriate.

Pedestrian safety, emergency access and property protection

• Pedestrians always have priority in pedestrian and shared areas.
• A vehicle must not be driven through an area occupied by pedestrians unless the movement is necessary, lawful and can be completed safely.
• Emergency routes, fire access, building entrances and vehicle exits must remain clear at all times.
• Attendees must promptly follow reasonable directions from Event Management or emergency services during an incident or emergency.
• A person who causes damage may be held responsible for the damage and reasonable clean-up or repair costs, to the extent permitted by law.

Event Management powers

To the extent permitted by law, Event Management may take any reasonable action needed to protect safety, property and the orderly conduct of the Event, including:

• refusing entry to a person or vehicle;
• directing a person to stop particular conduct or directing that a vehicle be moved;
• requiring a person or vehicle to leave the venue;
• restricting a person or vehicle from attending a future event;
• suspending, modifying or cancelling the Event; and
• contacting police, emergency services, the Venue Operator or another relevant authority.

These actions may be taken where Event Management reasonably believes that these Terms have been breached or that safety, traffic conditions, venue capacity, emergency access, property or the lawful operation of the Event is at risk.

A person directed to leave must do so promptly and must not return during the Event unless Event Management expressly authorises their return.

Filming and Photography

By entering this event or area, you are entering an area where photography, audio recording, and video recording may occur.

By being an attendee, you consent to such recording and to its release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, and inclusion on websites or social media.

You release the organisation, its officers, and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication of interviews, photographs, computer images, video and audio recordings.

If you do not wish to be subject to filming and photography, please do not participate or attend the event.  You can notify the event crew/photographer on site to be excluded, and all care will be taken not to use your image, however a guarantee cannot be given.

Incidents, CCTV and evidence

The venue and surrounding areas may be monitored by CCTV, photography, video or other security systems. Where lawful and appropriate, recordings and incident information may be used to:

• protect safety and security;
• investigate an incident, complaint, property damage or suspected offence;
• identify a person or vehicle; and
• provide relevant evidence to police, emergency services, an insurer, the Venue Operator or another relevant authority.

Following an incident, Event Management may prioritise safety, limit further vehicle movement, arrange medical assistance, record the date, time and circumstances, obtain vehicle registration and witness details, take photographs and preserve relevant recordings.

Legal requirements and approvals

These Terms are event and site conditions. They do not replace any permit, approval, traffic management plan, traffic guidance scheme, development approval, liquor approval, noise requirement, public liability insurance requirement or other legal obligation that applies to the Event.

Any event-specific instructions, venue rules or safety procedures issued by Event Management operate in addition to these Terms. Applicable law prevails if there is any inconsistency.

Responsibility for unauthorised conduct

A person who engages in unlawful, dangerous, reckless or anti-social conduct acts independently and contrary to these express conditions. WAHRA, the Event Organiser and the Venue Operator do not authorise or condone that conduct.

Nothing in these Terms excludes, restricts or limits any right or liability that cannot lawfully be excluded, restricted or limited under Western Australian or Australian law.

Governing law

These Terms are governed by the laws of Western Australia. Each Attendee remains responsible for complying with every law that applies to their conduct, vehicle and participation in the Event.

IMPORTANT: Anyone engaging in hooning, dangerous driving or anti-social behaviour may be required to leave immediately, and suspected offences may be reported to the Western Australia Police Force.
